STAYZAKO hereinafter referred to as the Office being a party to the contract of lease of the
Apartment for leisure or tourist stay with the Client.

  1. Client / Hirer – an individual or legal entity who is a party to a contract for the temporary use a dwelling (a contract for the rental of an Apartment for leisure or tourist stays) at the disposal of STAYZAKO.
  2. Flat – a residential unit, described in detail in the offer presented on the websitewww.stayzako.pl, which the Customer rents for a temporary stay for leisure or tourispurposes.
  3. Rental Agreement – a rental agreement, of an Apartment as defined by the Civil Code, for leisure
    or recreational purposes, concluded with the Renter by STAYZAKO. The of the Rental
    Agreement is calculated in Days;
  4. Reservation – the entitlement to use the flat under the terms and conditions set out inthe final booking confirmation.
  5. Day – a unit of time for the duration of the Rental Agreement, a Day begins at 16:00 on the
    day of the Client’s arrival and ends at 11:00 on the day of the Client’s departure.
  6. Resident – the person acting on behalf of the authorised Apartment holder, designated to theHirer by STYZAKO as the contact person for the Booking in question;
  7. Total service price – the remuneration for use of the Apartment specified in the booking
    confirmation. The price does not include city tax and any other additional charges. The hirer is
    bound by the prices that are published and confirmed at the time of booking. Promotions are not
    retroactive.
  8. Booking fee – in the amount specified in the booking confirmation necessary to maintain
    the booking.
  9. A one-off service charge added to the total price of the Booking Fee of between £50 an £150 depending on the type of facility, its service costs and the season.
  10. Security deposit – a fee in the amount specified in the booking confirmation, collected
    on the day of guests’ arrival, which is a security for any damage done by guests to the flat
    and failure to comply with the terms and conditions of the flat rental.The amount of the
    security deposit is imposed on a case-by-case and individual basis by the facility.
  11. Booking confirmation – an electronic document which is the only form of booking.

Chapter I.General provisions
These general terms and conditions for the use of the premises, hereinafter referred to as the Terms
and Conditions, form an integral part of the contract for the rental of the Apartment for leisure or
tourist stays concluded between the Client and STAZAKO, or an attorney representing
STAZAKO, declares that, by virtue of the agreement with the owner of the residential unit, hereinafter referred to as the Apartment, it is entitled, as part of its lease management, to provide services of making the Apartment temporarily available to clients for short-term leisure or tourist stays. As part of the rental agreement, it undertakes to prepare the Apartment for the Client and to make it available to the Client in return for the agreed remuneration. The bureau complies with the Code of Good Practice in Hospitality (Hotelier’s Code) 2004.

By entering into a rental agreement with STAYZAKO, the customer agrees to the processing of his/her personal data for the needs of the reservation process in accordance with the Personal Data Protection Act of 29.08.1997 (Journal of Laws No. 133/1997 item 833).


Chapter II. RESERVATION OF THE FLAT AND PAYMENT CONDITIONS

  1. Before making a reservation and concluding a rental agreement, the Client agrees to
    familiarise himself/herself with the content of these Rules and Regulations. Making a
    reservation is tantamount to accepting the Terms and Conditions.
  2. If you wish to receive an invoice for your stay, it is necessary to inform us of this at the time of
    booking and to provide your company name and VAT number. Otherwise, it will not be possible to
    issue an invoice due current legislation. Invoices and invoices for the stay are issued on request and
    sent by e-mail to the address indicated up to 7 working days from the date of check-out.
  3. An up-to-date catalogue of flats for short-term, tourist rental, together with their detailed
    descriptions, can be found at www.stayzako.pl. The photographs presented in the offer are for
    illustrative purposes only. There may be visible signs of use in the flats managed by
    STAYZAKO, which result from natural wear and tear of the flats and do not affect their use
    value.
  4. The flat is booked after consultation by phone or e-mail and confirmation by a company
    employee of the availability of the chosen flat, or after direct booking on the . After booking the
    flat on-line, phone or e-mail, the client will receive a form to his/her e-mail inbox with
    information on the booking and payment method.
  5. The booking is confirmed by the payment the booking fee, depending on the Offer chosen by
    the client, within 2 working days when making the booking. Exceptions can be made for Offers
    selected in the so-called high season, in which payment is obligatory, on the day of booking.
  6. The amount of the fee for renting the Apartment, including additional costs, is specified
    each time in the booking confirmation form received after booking or by telephone at the time
    of booking.
  7. The fee indicated in the price offer on the website and on the booking form includes 8%
    value added tax.
  8. Additional fees and deposits indicated on the booking form or contract, (city tax, deposit etc.)
    may be added to the rental fee. The flat rental fee does not include: additional cleaning during
    the stay, additional linen and towel change, cot rental, pet stay, parking cost, breakfast and any
    other additional services.
  9. The reservation fee is a fee that excludes a specific flat on a specific date from the
    STAYZAKO offer for another potential customer. If the booking is successful, the reservation
    fee paid will form part of the stay charge. If the reservation fee is paid within the required,
    deadline. The client will not be entitled to a refund of any monies paid.
  10. The remaining part of the fee for renting the Apartment, the Client can pay online using the
    electronic payment link sent in the email the Client receives after booking, or make a traditional
    transfer (the date of booking the payment counts) or pay on site during check-in.
  11. If the stay is shortened before and during the planned arrival, the client is obliged to pay the
    full cost of the nights cancelled.
  12. In the event of unforeseen circumstances beyond STAYZAKO’s control preventing the proper
    use of the Apartment, the company reserves the right to change the Apartment to another of equal or
    higher standard than the booked .
  13. If STAYZAKO is not in a position to provide the Hirer with alternative accommodation, it
    has the right to cancel the booking or part of the stay and is obliged to refund the amount paid by
    the Hirer, minus amounts for services already rendered.

Chapter III. RESIDENCE in the Apartment.

  1. The Client is obliged to inform the Facility, at least 24 hours prior to arrival, of the plannedtime of arrival at the Apartment by telephone or e-mail Check-in starts at 16:00 and ends at 11:00.
  2. The client’s arrival at the flat and the collection of the keys take place from 4 p.m. to 10 p.m. For check-in after 10 p.m. an additional fee of PLN 50 will be charged. Check-out before 7:00 a.m., an additional fee of PLN 50 will be charged, which the hirer should pay no later than on the day of check-in.
  3. In the municipalities, there is a municipal tax (the so-called tax), which depends the location of the facility, is not included in the price of the stay, and is payable in cash on the day of check-in.
  4. If the flat is included in the online check- in programme, the client will receive the entry code to the flat on the day of arrival at 15:45.
  5. If, during the Customer’s stay, damage has occurred to the flat which cannot be rectified immediately and makes it necessary to withhold the sale of this property or to cancel the booking
    immediately following the Customer’s stay, the Customer is obliged to cover the loss of financial
    benefits. The amount of lost benefits shall be immediately notified to the Customer by a
    representative of the Office. Payment of the amount related to the lost benefits does not release the
    Customer from the obligation to cover the damage caused during the use of the flat by the
    Customer. The Reservation Office reserves the right to deduct the amount of the lost profit from the
    deposit paid by the Customer by retaining the deposit / the Customer’s credit card.
  6. The end of the stay is by 11.00 a.m. on the last day of the booked period. The client is obliged to leave the flat by 11.00 a.m. (or any other time agreed with the Office). If the customer does not
    vacate the flat by 11.00 a.m., the Office will charge the customer 200 PLN or the cost of another
    night.
  7. The Client agrees not to keep animals in the Apartment (unless otherwise agreed). The Office charges a fee for staying with an animal in the amount of 40 PLN / per day. Failure by the Client
    to declare a stay with an animal may result in an additional fine of 500 PLN being imposed by the
    Office and this amount being taken from the deposit.

8. The client is obliged to keep their pet clean (this applies to both the flat and the balcony/terrace/garden). Otherwise, the Office reserves the right to impose a contractual penalty
of an additional PLN 300.

  1. The summoning of STAYZAKO employees or co-operating staff by the Client outside the Office’s working hours, in situations not endangering the life or health of the Hirer, not related to a
    serious breakdown that occurred in the flat during the stay and not attributable to STAYZAKO,
    will result in a penalty of PLN 200 being imposed on the Client and this amount being deducted
    from the deposit paid by the Client.
  1. STAYZAKO shall not be liable for any inconvenience caused during the stay of Guests in connection with construction or finishing works that may be conducted on premises where the
    flat is located as well as around it, interruption of the supply of utilities (e.g. electricity, water,
    central heating) for reasons beyond the control of the facility, noise emissions from neighbouring
    properties
  1. In the event that the number of persons actually residing exceeds the number of persons declared in the booking, STAYZAKO has the right to retain the funds paid towards the deposit, which will
    cover the cost of the stay in the flat of the additional person (not declared).
  1. In the event of an exceptionally gross or hooligan breach of the rules set out in this paragraph, STAYZAKO has the right to terminate the contract with immediate effect and
    remove the Client and his/her companions from the flat.
  1. During the stay in the Apartment, the Client has the right to make any comments or requests by
    calling the telephone number available on the information sheet provided on the day of check-in.
  2. The internet in the flats is for basic purposes only and during periods of high season, high occupancy the signal strength may vary, which cannot be the basis for a complaint.
  1. STAYZAKO is not responsible for the quality of the access roads to the property, and in winter wheel chains are mandatory for bookings of properties where they are required.
  1. STAYZAKO has the right to withdraw from the rental contract :

-The tenant does not have a valid identity card or is a minor,
-The tenant is under the influence of alcohol or other drugs;
-The tenant behaves in an aggressive manner,
-the number of persons arriving at the flat is greater than the number stated in the offer or other
circumstances not in accordance with the rules of the facility have occurred.

Chapter IV. OBLIGATIONS OF THE TENANT

  1. The Tenant is obliged to take care of the Apartment and its equipment. Any technical problems in the Apartment arising during the stay should be immediately reported by telephone. In the
    event of damage to the property, the Lessee undertakes to pay compensation fully covering the
    value of the loss, not later than on the day of departure.
  2. Smoking is strictly forbidden, a breach of the ban will incur a fine of PLN 500, which the hirer undertakes to pay in cash on the day of departure from the flat at the latest.

3. Pets are not accepted (unless otherwise agreed). Breach of the ban entails a fine of PLN 500, and an additional fee of PLN 40 / day, which the hirer undertakes to pay no later than on the day
of departure.

  1. The loss of keys incurs a fee of £250.
  2. The facility has a curfew from 22:00 to 07:00 ;The behaviour of the hirer should not disturb other people in the facility. Aggressive, noisy behaviour under the influence of alcohol or intoxicants will not be accepted by STYZAKO and may result in immediate termination of the contract without refund of fees previously made, including refunds for unused nights.
  1. The hirer is obliged to inform the relevant services in the event of a breach of curfew by otherpersons on the premises. In accordance with the regulations in force, incidents must be reported individually.
  1. Due to fire safety requirements, it is not allowed to use in the flat any appliances or devices powered by electricity or gas which do not belong to the equipment of these rooms and which
    may create a fire hazard, e.g. electric heaters, heaters, gas burners, flares. It is forbidden to bring
    flammable materials, explosives and materials with an unpleasant smell into the flat.
  1. During your stay in the flat, you are obliged, each time you leave the flat, to secure the flat,i.e. to close the windows and doors, please check that they are locked. It is strictly forbidden to take out items that are furnished in the flat (e.g. towels, blankets, pillows, appliances, etc.).

Chapter V. Check-out and handing over of keys.

  1. The Customer is obliged to leave the Apartment at the time indicated in the booking by 11.00 a.m. Exceeding the check-out time will result in an additional charge (penalty) of PLN 200.
  2. Check-out must be arranged with the Resident of the accommodation no later than 7 p.m. on the day before the end of the stay and planned departure.
  3. Items left by the guest after leaving the flat may, at the guest’s request, be returned at the guest’s expense to the address specified by the guest. Otherwise, after three days from the date of the
    guest’s departure from the flat, the staff will deal with the items in accordance with the regulations
    on lost or found items.
  4. Flat tenants are obliged to maintain cleanliness during their stay and to segregate waste, and on the day of departure they are obliged to dispose of rubbish in containers
    indicated by the staff.
  5. The rented flat must be left in the same condition as it was on the day of arrival. Leaving the apartment in a condition requiring a non-standard cleaning service will result in additional costs
    determined individually and added to the total cost of the stay.

Chapter VI. Withdrawal from the contract

  1. The customer has the right to withdraw from the rental contract without stating a reason. 2. The right to withdraw from a contract concluded online is governed by the Consumer Rights Act
    of 30 May 2014, which implements EU Directive 2011/83. It follows from this Act that the right to
    return goods purchased online does not apply to accommodation services.
  2. If the customer exercises the right of withdrawal during the stay, he/she is liable for all charges relating to the booking, i.e. he/she forfeits the booking fee paid and is also obliged to pay the
    remaining fee for the stay.
  3. .Withdrawal from the contract must be made by contacting the telephone or email indicated in this contract.

Chapter VII. Complaints.

  1. The customer has the right to lodge a complaint about the conditions of stay, standard of service, other factors under the influence of STAYZAKO. The customer has the right to
    pursue a complaint in accordance with the applicable laws.
  2. To be considered, a complaint must be submitted electronically to the email address. stayzako@gmail.com. The complaint should contain the following information: booking
    number, description of the situation subject to complaint.
  3. The complaint will be considered within a maximum of 30 days of receipt. Information on the outcome of the complaint will be sent to the Customer at the e-mail address, postal address or by
    telephone. If the complaint is upheld, the Customer will be compensated in an amount
    proportional to the damage suffered.
  4. If STAYZAKO does not accept the Customer’s complaint and the Customer does not agree with its decision, the Customer has the right to assert its claims in accordance with the provisions of the
    Civil Code.

Chapter VIII. Final Provisions.

  1. STAYZAKO is not responsible for difficulties in accessing the booking system.
  2. Neither STAYZAKO nor the owner of the Apartment shall be liable for the Customer’s property left in the Apartment, in particular for its loss or damage.
  1. Neither STAYZAKO nor the owner of Apartment shall be liable for any inconvenience that may arise during the Client’s stay in the Apartment due to reasons beyond the control of STAYZAKO or
    the owner, including, in particular, those caused by the interruption of the in the supply of electricity, gas, water, as well as maintenance work in the building in which the
    Apartment is located and within the building and outside.
  1. The Client undertakes to provide data necessary for the fulfilment of the booking that is true and

identifiable (incorrect or false data may result in the inability to provide the Client with the
information necessary for the Client’s stay in the flat). STAYZAKO is not responsible for the
impossibility of contacting the Client prior to arrival if the data provided by the Client turned out to
be untrue or erroneous.

  1. Items left by the guest after leaving the flat may be sent back at the guest’s expense to the address specified by the guest at his/her request. Otherwise, after three days from the date of the guest’s
    departure from the flat, the staff will deal with the items in accordance with the regulations on lost
    or found items.
  1. The flat attendant or service staff has an extra set of keys, and in the event of emergency breakdowns, faults can enter the flat to repair them while guests are away from the flat.

Chapter IX: PROCESSING OF DATA.
Personal data will be processed in order to carry out the booking process, to clarify the
circumstances of possible violations of the Rules and Regulations or applicable laws, and to
handle possible complaints.
In accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament
and of the Council of 27 April 2016 on the protection of natural persons with regard to the
processing of personal data and on the free movement of such data and repealing Directive
95/46/EC (RODO), we inform you that:
The administrator of the personal data obtained during the booking process within the meaning of
the applicable common law, is STAYZAKO Marta Kumala Ul. Kierpcówka 3B Koscielisko 34-511 The entity
processing the personal data is the online booking system Hotres.pl

  1. For the purpose of the booking process / issuing of the sales document, the personal data of the
    Guest is collected. The provision of personal data is voluntary, but necessary to complete the
    booking process.
  2. The visitor has the right of access to the content of his/her personal data, the right to
    rectification, deletion, as well as the right to restrict its processing.
  3. The Guest’s optional consent to have their data processed for marketing purposes requires
    them to tick the relevant ‘checkbox’ during the booking process. This consent can be
    withdrawn by sending an appropriate message to e-mail:stayzako@gmail.com.
